Candy Wrapper and Scrapbook Designs TERMS OF USE

• PERSONAL USE:  Designerz Cafe grants you the right to use any designs offered for your own personal use and creativity.  We retain all copyrights to the materials. 
  PERSONAL USE does NOT include a finished product for digital download to groups or forums such as, emails, mailing lists, download sites, this includes cd/dvds, graphic collections, website links or other such media where people who have not purchased a membership.
• COMMERCIAL USE: Designerz Cafe grants you, as a member of this site, the right to use any and all designs offered to be used commercially.  This means you may use them to sell TO your customers as incorporated INTO a creative project.  (We do not require our copyright on wrappers and works but if you use them commercially you must have a credit on your site or business material you show the designs on.  Any violation could cause termination of your membership with no refund of membership fees.
• PRINTABLES:  You may use our printables for your commercial or personal use on hand printed finished items.  They are NOT to be shared on any forum, website, or offered for download from any website or digital format.  They need to be a finished product BEFORE offering to your customer.  The word SAMPLE or your watermark needs to be displayed on the wrapper when using a sample on your website.  Printables include: Scrapbooking quickpages, embellishments, bragbooks, binder buddies, and cookbooks.  Anything we offer in the printables section applies to this.
• You may use for personal and commercial use provided you do not claim them as your own.  May NOT be sold in original format.  You must create something with them.
• Background tiles and fractal designs may not be sold in original format but used in a creative work for personal and commercial useage. 

COPYRIGHTED MATERIALS. 

1. "Materials? on Candy Wrapper and Scrapbook Designs shall constitute and be defined as any files, images, animations, photographs, or text available on Candy Wrapper and Scrapbook Designs.
   
   
2. All Materials downloaded from Candy Wrapper and Scrapbook Designs is licensed to you by Candy Wrapper and Scrapbook Designs  Downloading these Materials does not transfer any title from these Materials to you, or any intellectual property rights therein to you. 
   
   
3. You may under no circumstances redistribute or sell this content at any time, and it is illegal to duplicate, download, or distribute any Materials from Candy Wrapper and Scrapbook Designs except for your use, which is subject to the Usage Guidelines.
   
4. The design and layout, as well as all Materials provided on the Site, or of any other website owned, operated, licensed, or controlled by or associated with Candy Wrapper and Scrapbook Designs, is protected by the United States and International law and other intellectual property proprietary rights and may not be copied or imitate in whole or in part.
    

LIMITATION OF WARRANTY.

IN NO EVENT WILL LIABILITY OF Candy Wrapper and Scrapbook Designs OR ANY OF ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, LICENSERS, SUPPLIERS OR DISTRIBUTORS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THIS SITE, OR PURCHASING OR DOWNLOADING PRODUCTS FROM THIS SITE. These Terms of Use contain the entire understanding of the parties hereto relating to any use of this Site and supersedes any prior written or oral agreement or understandings between the parties with respect to this Site, and cannot be changed or terminated orally. The invalidity or unenforceability of any provision of these Terms of Use will not affect the validity or enforceability of any other provision of these Terms of Use. Candy Wrapper and Scrapbook Designs reserves the right to modify or terminate these Terms of Use without notice, if, in Candy Wrapper and Scrapbook Designs sole discretion, you fail to comply with any term of these Terms of Use. Upon termination, you must destroy all materials obtained from this Site, copies and related documentation thereof. In addition, Candy Wrapper and Scrapbook Designs reserves the right to terminate this Site without notice.
